Terms of Service and Sale

VitraWeb is operated by the publisher identified in the Legal Notice. By creating an account, subscribing or using the service, you accept these Terms and the Privacy Policy.

The service is intended for professional use and commercial purposes, including for individuals looking to generate income, start a business, or create websites for clients. By subscribing, you confirm that you are using the service for professional or commercial purposes (such as side-hustle revenue generation or client projects) and that you are not acting as a consumer. Consequently, consumer protection regulations, including any statutory cooling-off or right of withdrawal, do not apply to your subscription.

VitraWeb Build provides AI-assisted creation and revision of one-page websites, hosting and publication tools, structured settings, email forwarding for contact or booking forms, HTML exports, backups, domains and related features.

Features may evolve. No result generated by AI is guaranteed to be unique, error-free, legally compliant or suitable for a particular professional activity. The user must review every website before publication.

Account information must be accurate. Credentials are personal and must be protected. Suspicious, automated, fraudulent or abusive activity may be rate-limited, suspended or terminated.

Accounts may be retained so the user can subscribe again.

Starter includes 100 AI credits per billing period, Pro 300 and Agency 800. Creating a website costs 20 credits and each AI modification costs 10. Unused credits expire at renewal and do not roll over. Upgrades recalculate the current balance from credits already used; downgrades apply at the next renewal.

An upgrade applies after Stripe confirmation and payment of the fixed difference between the current and target monthly plan, without day-based proration. A downgrade is scheduled for the next renewal. Current credits remain available until then and the lower credit allowance starts with the new billing period.

Lead Finder includes up to 50 newly imported businesses without a website detected by Google per billing period on Starter, up to 200 on Pro and up to 400 on Agency. Detection reflects Google data at search time and is not a guarantee. Duplicate Google Place IDs do not consume the allowance. Unused Lead Finder capacity does not roll over.

Prices are shown before payment and are billed monthly through Stripe. Subscriptions renew automatically until cancelled. Taxes may apply depending on the customer’s status and location.

Cancellation takes effect at the end of the current paid period. Access remains available until that date. When access ends, websites, uploaded photos and associated public domains are permanently removed. The user must download the signed backup beforehand.

Payments and started billing periods are non-refundable for a change of mind, non-use, insufficient use of included quotas or failure to cancel, except where mandatory law requires otherwise.

Any refund request based on a mandatory legal obligation or an acknowledged service failure must be sent to vitraweb.fr@gmail.com, identifying the account, payment date and grounds for the request.

The user retains rights in content they provide and grants VitraWeb Build the limited rights required to process, host, transform and transmit it. The user warrants that photos, reviews, trademarks, menus, copy and other materials may lawfully be used.

Subject to third-party rights and applicable law, the user may use, publish and export generated websites for their own business or clients. AI output may resemble other material and is not guaranteed to be exclusive or protectable.

Visitor messages are forwarded to the contact email configured for the website and are not intentionally stored in a site-messages database. The user remains responsible for the recipient address, the business’s privacy notices, lawful processing of leads and reservation availability.

The service may not be used for unlawful, deceptive, infringing, hateful, malicious or fraudulent content; impersonation; phishing; malware; unsolicited bulk messaging; circumvention of quotas or security; resale of platform access; or interference with the infrastructure.

Lead Finder assists research but does not authorize unlawful outreach. The user is responsible for verifying the applicable rules, informing prospects where required, respecting objections and avoiding unsolicited bulk communications. Google Places information remains subject to Google’s applicable terms and attribution requirements.

The service is provided with reasonable care but without a guaranteed uninterrupted availability. Maintenance, providers, APIs, DNS, AI models and email delivery may cause delays or interruptions.

To the extent permitted by law, VitraWeb Build is not liable for indirect loss, lost profits, lost opportunities, customer disputes, content errors or loss caused by failure to export a backup. Nothing excludes liability that cannot legally be excluded.

Affiliate commissions are calculated from verified Stripe payments made by valid referred accounts. The default affiliate rate is 5% of the referred customer payment, unless VitraWeb Build assigns a custom rate to a specific referrer. Affiliate and creator commissions are pending for 30 days before becoming withdrawable. Refunds, disputes, fraud or abuse may reverse commissions. If a payout has already been paid manually, later reversals may create a negative balance that is offset against future commissions. Self-referrals, duplicate identities, coordinated accounts and artificial payments are prohibited. Payout requests may be reviewed before manual payment.

Affiliate and creator commissions remain pending for 30 days before becoming withdrawable. Later refunds or disputes can create a negative balance if a payout was already paid manually.

These Terms and all professional relationships arising from the service are governed by French law. Before initiating proceedings, the parties should seek an amicable solution by contacting support.

If no amicable solution is reached, the dispute will be submitted to the competent courts determined by the applicable procedural rules.
